Regulasi Climate Migrants di Regional ASEAN : Urgensi dan Isu Hukum

Perubahan iklim semakin diakui sebagai pendorong migrasi yang signifikan di Asia Tenggara, di mana naiknya permukaan air laut dan peristiwa cuaca ekstrem mengancam mata pencaharian dan tempat tinggal jutaan orang. Menelaah peraturan dengan menggunakan pendekatan komparatif terhadap kerangka hukum negara-negara anggota ASEAN, terlepas dari kebutuhan mendesak akan tata kelola yang efektif, ASEAN masih belum menetapkan pengakuan atau perlindungan yang komprehensif bagi para migran iklim. Instrumen hukum yang ada saat ini, seperti Perjanjian ASEAN tentang Penanggulangan Bencana dan Tanggap Darurat, memberikan landasan untuk kerja sama tetapi tidak memiliki ketentuan khusus yang membahas hak-hak individu yang terlantar. Karena proyeksi menunjukkan bahwa jutaan orang akan mengungsi akibat dampak iklim pada tahun 2050, maka menjadi sangat penting bagi negara-negara anggota ASEAN untuk mengintegrasikan masalah migrasi ke dalam strategi adaptasi iklim nasional. Integrasi ini akan memfasilitasi pengelolaan yang lebih baik atas kebutuhan para migran iklim dan mendorong stabilitas regional. Selain itu, kawasan ini juga membutuhkan kerangka hukum untuk meminta pertanggungjawaban setiap negara anggota atas tindakan mereka terhadap para migran iklim. Pada akhirnya, meskipun komitmen kolektif ASEAN mencerminkan langkah untuk mengatasi tantangan-tantangan ini, langkah-langkah yang lebih kuat dan mengikat sangat diperlukan untuk melindungi hak-hak dan kepentingan para migran iklim di Asia Tenggara
